PDFidelity Terms and Conditions of Use

PDFidelity is an independent digital product created and operated by Andy Geek as an individual developer, not through an incorporated company. The platform combines service-owned materials with open-source code released under the GNU Affero General Public License v3.0 (AGPL-3.0). By using the service you interact directly with an individual developer, accept the conditions that apply to the service, and acknowledge the open-source licenses described below.

1. Acceptance of the terms

By accessing or using PDFidelity (the service) you acknowledge that you have read and agree to these Terms and Conditions.

To create an account you must expressly accept these Terms and the Privacy Policy. PDFidelity may keep technical evidence of that acceptance, including the accepted version, date, language, and signup source.

If you disagree with any part, you should not use the platform. By creating an account you confirm that you have legal capacity to contract and that the information you provide is accurate.

2. Description of the service

PDFidelity is an online platform that facilitates translations of PDF files.

The PDFidelity name identifies the product, not an incorporated company. No registered trademark status is claimed for PDFidelity.

PDFidelity is powered by the open-source pdfidelity_core codebase and the upstream PDFMathTranslate/PDFMathTranslate-next project, both released under the AGPL-3.0. Additional service infrastructure, such as hosting and billing, is maintained separately.

3. Permitted use and user obligations

You agree to use PDFidelity in a lawful and respectful manner, without infringing third-party rights or uploading unlawful content.

You are solely responsible for the documents you upload, share, or download and for any decisions you make based on the generated translations.

If you use PDFidelity with medical, legal, regulatory, financial, or other high-impact documents, the results are only a reading or research aid. They are not professional advice, diagnosis, treatment, certification, or a substitute for specialized human review.

4. User content and temporary storage

Files from accounts without an active plan remain on the servers for up to five calendar days and are then deleted automatically.

With an active paid plan, documents are kept while there is activity. If 30 days pass without use, an in-app warning is sent and the documents may be deleted 7 days later unless you open or download them again.

You must keep your own backups. Availability or recovery of documents after that window is not guaranteed.

5. Intellectual property and open-source components

Original PDFidelity content, including design materials, logos, marketing text, user documentation, and the service configuration, belongs to its respective owners or is used under the applicable licenses. It is not automatically licensed for your reuse.

The pdfidelity_core software that operates the translation workflow is distributed under the AGPL-3.0. You may review, use, and share that code under the terms of that license; see https://github.com/andygeek/pdfidelity_core for the published source.

6. Third-party services and software

PDFidelity integrates the PDFMathTranslate/PDFMathTranslate-next project, external artificial intelligence services, and other cloud infrastructure to produce translations.

It also relies on external providers for authentication, storage, payments, consented analytics, consented advertising, abuse protection, internal notifications, and operational support.

Those providers operate under their own terms and policies. Their availability, response times, security measures, and data handling may depend on them.

7. Plans, payments, renewals, and refunds

Subscription plans are billed monthly through external providers such as PayPal, Polar, or the applicable mobile app stores. Extra credits are one-time payments and are added to the account balance when the provider confirms payment.

Each plan displays its monthly pages, per-document limits, and price before checkout starts. Plans are not unlimited.

Subscriptions renew automatically until you cancel renewal from your account settings or the corresponding payment provider. Cancellation stops the next renewal but normally keeps access until the end of the paid period.

Unless applicable law or the payment provider requires otherwise, confirmed payments, consumed extra credits, and current subscription periods are non-refundable. If there are duplicate charges, verifiable technical failures, or billing errors, email andy@andygeek.com for review.

Prices, limits, and features may change. If a material change affects an active subscription, notice will be provided before it applies whenever reasonably possible.

8. Disclaimer and limitation of liability

PDFidelity is provided as is and as available. To the fullest extent permitted by law, I disclaim liability for direct, indirect, incidental, consequential, or lost-profit damages arising from using or being unable to use the platform.

You use the service at your own risk and acknowledge that results may contain errors or inconsistencies inherent to artificial intelligence and third-party software.

  • Errors, omissions, or inaccuracies within translations generated by artificial intelligence, pdfidelity_core, or the PDFMathTranslate/PDFMathTranslate-next project.
  • Decisions you make based on translated content.
  • Damages or losses stemming from interruptions, delays, technical failures, or automatic file deletion after the stated retention period.

9. Indemnification

You agree to indemnify and hold Andy Geek harmless from claims, damages, losses, liabilities, costs, or expenses (including reasonable legal fees) resulting from your use of the service or your breach of these Terms and Conditions.

10. Service availability and changes

I may modify, suspend, or discontinue PDFidelity at any time without prior notice.

There is no guarantee that the service will be error-free, uninterrupted, or free from vulnerabilities.

11. Privacy and data protection

Accounts and personal data are managed through Google Firebase under its own terms and policies.

Review the PDFidelity Privacy Policy to understand how data is handled. Using the service means you accept those practices.

12. Changes to the terms

I may update these Terms and Conditions at any time. The current version will be published with its effective date.

When a material change affects payments, personal data, or essential rights, I will try to provide notice through the platform, email, or renewed acceptance when appropriate.

13. Governing law and jurisdiction

These terms are interpreted under the regulations applicable to use of the service and respect any non-waivable consumer protection rights that apply in your place of residence.

Disputes related to PDFidelity must be brought before the competent courts under applicable law. If you use the service as a consumer, nothing in these Terms limits the venues, rights, or protections granted to you by consumer law.

15. Communications

PDFidelity may send transactional or service communications, such as security, billing, important changes, account status, support, and operational notices.

Promotional or marketing communications are not a condition of creating an account. They will only be sent when there is a valid legal basis or consent, and they must include a reasonable way to opt out.

If you do not agree with these conditions, please do not use PDFidelity. You may still exercise any rights granted under the AGPL-3.0 with respect to the released source code.
